.

.

occAntal Oil
March 14, 1980

Shale, Inc.

present policy of determining the practicability

of the elimination or reduction of salt discharge

from each operation, taking into account technical

and economic feasibility on a case-by-case basis,

(c) Colorado is a water-short state. Existing and

future development will require full utilization

of available water. It is important, therefore,

in keeping with our state policy of maximum

utilization of water for beneficial uses, that

in the implementation of the Colorado River

salinity standard we do not encourage wasteful

treatment methods or unnecessary consumption

of water.

(d) We would like to point out that the Federal Treaty

with Mexico imposes a unique burden for control of

quality on users of the Colorado River. Individual

water users, whether they be large industrial cor-

porations or individual farmers cannot be expected

to assume the obligations entered into on behalf

of the entire nation by the federal government.

In this regard there should be a clear recognition

of federal responsibility for salinity control.

Consistent with the above comments, Occidental suggests that

Regulation 3.9.5, IMPLEMENTATION, be amended to read as follows:

The proposed plan of implementation is being
considered separately for possible policy
approval by the Water Quality Control Com-
mission. The water quality standard for
salinity will be implemented primarily through
the cooperative efforts of the federal govern-
ment and the seven member states of the Colorado
River Basin Salinity Control Forum. To the
extent technically, economically, and legally
feasible, the salinity standard will be imple-
mented through programs developed under sections
208 and 402 of the Federal Clean Water Act and
the corresponding State requirements, C.R.S. 1973,
25-8-401 through 406, and 25-8-703.

-4-

141'2

~,_.-:-...... :-. -~, ~.~, .-._.-....._~ _,;-~-'-, .."":t:._'_' ___
