These opera ling criteria shall affect all surface and underground water <br /> <br />[is defined in Section 148-21-3(3) and (4), Colorudo Revised Statutes 1963, as <br /> <br />amended, as follows: <br /> <br />"(3) 'Waters of the state' means all surface imd underground water in <br />or tributary to all natural streams within the State of Colorado, except <br />waters referred to in 148-18-2(3). <br /> <br />(4) 'Underground water' as uppJied in this <lct for the purpose of ddininl:j <br />tho waters of d natural stream I rn0.(ln~; th;)t \,\Ti-lter in the unconsolidated <br />cllluviul aquif0.r of sand f gravel I and other sedtmetltury materials f and <br />all other waters hydraulically connected thereto which can influence the <br />rate or direction of movement of the water in that alluvial aquifer or <br />natural stream, Such 'underground water' is considered different <br />from 'designated ground water' as defined in 148-18-2(3)." <br /> <br />except water withdrawn from wells, such as domestic and livestock, exempted <br /> <br />from administration under Section 148-21-45, ("AJlorado Hevised Statutes 1963, <br /> <br />as amended. <br /> <br />II, Administration of all water, both surface and underground, will be based <br /> <br />on the fact that the delivery of certain quantities of water pursuant to the <br /> <br />Rio Grande Compact constitutes tbe most senior water right in the Rio Grill1de <br /> <br />Basin. As a result, all other water rights, whether deriving from surface water <br /> <br />or underground water, may be regulated at those times and to the extent necessary <br /> <br />to deliver the amount of water required pursuant to the terms of that compact. <br /> <br />III.
