Colorado has no effective salinity con- <br />trols in any 303(e) or 208 plans to fall back on, if it repeals <br />this 303(a)-(b) plan. Colorado will be left with no implementa- <br />tion, no stated means at all of controlling salinity. <br /> <br />Colorado has clear obligations under the new EPA regula- <br />tions governing water quality management ("WQM"). 40 C. F. R. <br />Parts 35, 130, 131, 44 Federal Register 30016 (May 23, 1979). <br /> <br />The clear requirement and paramount importance of imple- <br />mentation runs throughout these regulations: <br /> <br />Implementation is the most impor- <br />tant part of the WQM process, because <br />only with successful implementation <br />will water quality goals be achieved. <br />Implementation of solutions to water <br />quality problems involve many programs <br />and agencies at all levels of govern- <br />ment. Implementation may include con- <br />struction of treatment works, regula~ <br />tory or non-regulatory point and non- <br />point source control programs, legisla- <br />tive initiatives, enforcement, and <br />other activities to meet water quality <br />goals. Not all implementation relates <br />to the 208 plan per se; the State uses <br />funds under Section 106 of the Act to <br />manage a wide range of WQM activities, <br />including permit activities under title <br />IV of the Act. Various remedies are <br />available to EPA to deal with failures <br />of implementation. <br /> <br />44 Fed. Reg. S 35.1503(g) (emphasis added). <br /> <br />The requirement is not satisfied by vague, non-specifics, <br />such as the current proposal: <br /> <br />The fundamental objective of all <br />activities of State and other agencies <br />under this subpart shall be to achieve <br />the water quality goals of the Act. <br />Therefore, all planning shall aim at <br />specific implementation action. EPA <br />shall not exercise any approval author- <br />ity under this part, nor award any <br />grant, unless the Regional Administra- <br />tor is satisfiec1 thi'lt t_he action for <br />which approval or grant funds is sought <br /> <br />145Z <br />
