<br />002838 <br /> <br />o <br /> <br />House Bill 1041, 1974 - Land Use Act which concerns geologic hazard <br />areas of state interest, including functions of other state agencies <br />and technical and financial assistance, <br />Senate Bill 126, 1977 - State to establish criteria and requirements <br />for performing floodplain studies in local, state and federal <br />governments. <br /> <br />o <br /> <br />In 1977, the Governor reinforced a concern for sound floodplain management by <br />issuing two executive orders concerning the evaluation of flood hazards in <br />locating state facilities and state participation in the National Flood <br />Insurance Program. <br /> <br />The flood control and floodplain management section of the board has developed <br />several programs directed towards the identification of floodplains and <br />providing technical services to Colorado communities. State statutes and <br />executive orders regarding floodplain management can be found in the Flood <br />Hazard Mitigation Plan for Colorado, prepared by the Colorado Water <br />Conservation Board and the Division of Disaster Emergency Services. <br /> <br />Dam Safety <br /> <br />The safety of dams in Colorado is the primary responsibility of the Division <br />of Water Resources (State Engineer) under the Department of Natural <br />Resources. Dam Safety programs developed by this agency are administered <br />under authority of the following: <br />o Title 35, Article 49, Colorado Revised Statutes, Agriculture, <br />Livestock Water Tanks. <br />o Title 37, Article 87, Colorado Revised Statutes, Water and <br />Irrigation, Reservoirs. <br /> <br />The State Engineer is required to approve plans for reservoirs and to <br />supervise the construction of dams (CRS 37-87-105), to "annually determine the <br />amount of water which is safe to impound in the several reservoirs within this <br />state" (CRS 37-87-107) and "upon complaint" examine a reservoir and <br />"determine the amount of water it is safe to impound therein" (CRS 37-87-109). <br /> <br />For further detail on liability of dam breakage and the inspection of dams, <br />see the Flood Hazard Mitigation Plan for Colorado. <br /> <br />- 53 - <br />
