Thus, a <br />formal consultation package <br />also generally contains an <br />"incidental take statement." <br />50 C.F.R. & 402.l4(i). <br />Incidental take is that take <br />which occurs as a result, but <br />not the intent, of an <br />otherwise lawful activity. 16 <br />D.S.C. & 1539(a) (l)(B); 50 <br />C.F.R. & 17.3 (1993). <br /> <br />The incidental take statement <br />contains an estimate of the <br />anticipated take, a <br />determination that the level <br />of take is not likely to <br />jeopardize the species, and <br />the nondiscretionary actions <br />(reasonable and prudent <br />measures with their <br />implementing terms and <br />conditions) that must be <br />undertaken onsite to minimize <br />the take. 50 C.F.R. <br />& 402.14Ii). <br /> <br />(g) Irreversible and Irretrievable <br />Commitments. <br /> <br />i. Section 7(d) of the Act <br />prohibits the action agency <br />and the applicant from making <br />any irretrievable or <br />irreversible commitment of <br />resources during formal <br />consultation that would <br />preclude the development of <br />reasonable and prudent <br />alternatives. 16 U.S.C. <br /> <br />& 1536(d).
