Rehearing denied September 23, 1929. <br /> <br />Action for injunotion. Judgment of dismissal. <br /> <br />Affirmed. <br /> <br />1. HATER RIGllTS--Appropriations. The statute reoognizes two olasses <br />of appropriations, one for ditohes diverting water direotly from the <br />stream, and One for storage of vtater to be used subsequently. <br /> <br />2. nORDS AND Pl1,;.3J~S--Temporary. "Temporary" lreans lasting for a <br />time only; it is opposed to permanent. <br /> <br />3. \"lATER RIGHTS--Nature. The right to the use of water whether by <br />direot flmv or through storage reservoirs is a usufruotuary right. <br /> <br />4. Direot Irrigation Deoree--Storage. An appropriator of water <br />oannot store it for future use when he has appropriated it and ob- <br />tained a deoree for direot irrigation only. <br /> <br />5. Distrioution--Offioials. Publio offioials oharged with the distri- <br />bution of uater must distribute it aooording to the deorees therefor. <br /> <br />6. <br /> <br />Court 'Pm1ers--Limitations. <br />Supreme Court, and it has <br />as to tiIne. <br /> <br />Former adjudioations are binding upon the <br />no p~'er to abolish statutory limitations <br /> <br />7.
