<br />Cubic Feet Per Second (efs). Sometimes referred to as "second feet," cfs is the basic <br />measurement of flowing water. A cfs is roughly 7.48 gallons per second, which 646,317 gallons <br />per day. Thus a flow of or right to 1 cfs is a flow of or right to 646,317 gallons in 24 hours, <br />which is almost 2 acre-feet. <br /> <br />Dilil!ence. An appropriator must proceed with reasonable diligence to build structures necessary <br />to apply water to beneficial use. What constitutes reasonable diligence is decided by the courts <br />in light of all the circumstances of the particular case. A 1982 Supreme Court decision <br />stipulates that project-specific and often dirt-stirring work is needed to show diligence. Holders <br />of conditionally decreed water rights are now required to come into court every four years and <br />proved they have been diligently pursuing completion of their water rights. <br /> <br />PerfectiDl!: a Water Ril!ht. Establishing a decree for an absolute water right from a conditional <br />water right decree. , <br /> <br />Instream Flow Water Ril!ht. An amount of water within a stream channel that is protected by <br />a recognized water right. <br /> <br />Law of the River. All laws pertaining to the basinwide allocation and use of water of the <br />Colorado River and its tributaries. Includes interstate compacts, the treaty with Mexico, Federal <br />water project authorizations, and the water laws of individual states. <br /> <br />Section 7 Consultation. Section 7 of the Endangered Species Act requires all Federal agencies <br />to consult with the Fish and Wildlife Service to determine impacts of any action or decision to <br />any species protected under the Act. <br /> <br />Water Ril!:ht. A grant, permit, decree, appropriation, or claim to the use of water for beneficial <br />purposes. In Colorado, the priority (seniority) of a water right is established by a "first in time, <br />first in right" appropriation doctrine. <br /> <br />1975 Exchanl!e Al!:reement.
