UUl"<lCl

OO\1..>~

Cll

2

III. BI.M - Pogue River Easarent. This deed was supplied by Gordon Gray,
Bureau of Land Managemmt, Medford, Oregon, as a standard form
scenic easenent deed for recreational river areas (Pogue River).
This form allows for alternative language in several clauses to
better pattern the deed to its intended objective.

e

IV. Sanple for wild and Scenic Rivers. This deed form is the
prcrluct of a w:>rkshop brainstorming session at the Boise TlEeting
and inoorporates features of other Forest Service easerrent
deeds and that of the BurE'.au of Land Management. This ferm
was a result of the oonsensus that one boilerplate deed w:>uld
suffice for any river in the system so long as it had optional
w:>rding to fit it into the appropriate use and designation
of the particular river. The deed a:mtains nlllTErous clauses
1rIhich the drafter can choose to fit the area. Alternate
language is typed in italics. Sate felt a tennination clause
was illlllecesScu:y and that sore deeds might require a severability
clause if there is language of questionable legality inserted;
the form as written would not require a severability clause.

.

V.
