<br />. <br /> <br />. <br /> <br />limit any adverse impacts to water users in the Gunnison Basin, satisfy ESA-Section <br />7 consultation on the Aspinall Unit of CRSP, and maintain reasonable levels of <br />hydropower production. <br /> <br />The BOR and cooperating agencies have determined that the contract will <br />require NEPA compliance and that an EIS will have to be prepared. The BOR has <br />proposed that the EIS and contract negotiations occur simultaneously. <br /> <br />Status <br /> <br />BOR and cooperating agencies held public informational meetings on April 28- <br />c..M:: ~ <br />30 in the Gunnison Basin and the Stlat'd was provided a memorandum at its May 7-8, <br />1992 meeting outlining issues of concern and technical needs. The NEPA scoping <br />meetings were held on May 19-21, 1992 in the Gunnison Basin. The scoping comment <br />period was formally closed on July 15, 1992; however, comments received after July <br />15, 1992 will still be considered during the process. Attached hereto is a list of <br />general issues which outline the basic structure the scoping document and EIS will <br />take. We emphasize that these are general issues which are intended to encompass <br />all the various perspectives that the comments took. The various individual <br />perspectives will be addressed as the NEP A process proceeds. <br /> <br />Issues <br />1. Should the State continue to participate in the negotiations to arrive at a <br />quantification of the Reserved Right via a contract or should the quantification <br />be contested in the water court without further negotiations on a contract? <br /> <br />Items to consider: <br /> <br />A. It has been established that the contract will be subject to NEPA <br />compliance and as a result consultation with EPA and with the U.S. Fish <br />and Wildlife Service (USFWS) under section 7 of the Endangered <br /> <br />000987 <br />
