V
I

.

.

. l ~. ~

- 61 - .

'-,

'-

Moreover, it is not certain that Flaming Gorge

water is available~ It is represented in the DEIS that

the Water and Power Resources Service has given "initial

indication that water is available" for purchase and

that Deseret filed an application on July 11, 1980 for

purchase of up to 30 cfs. DEIS at 80. However, there

is no indication in the DEIS that Deseret's application

has been granted nor that WPRS has done any environmental

analysis, or proposed a draft EIS, on this transaction.

Thus the availability of such water remains speculative.

Even if "additional" water were to be released

from Flaming Gorge (which, as noted above, does not ap-

pear to be practical) it would risk significant altera-

tion of the endangered species habitat on the stretch

of the Green River from the dam to Walker Hollow. Under

present Fish and Wildlife Service policy, this could not

be lawfully undertaken under the Endangered Species Act

until completion of the U.S. Fish and Wildlife Service

study on endangered species referred to above.

'-

~

,

03'71
