Smith, Deputy State Engineer ~' A . - SUBJECT: Water Rights on the Yampa River - Water District 44 Attached per your request is a list of water rights on the Yampa River in Water District 44 showing the name of the ditch, source, location, amount, adjudication date, previous adjudication date, and appropriation date. They are listed in the order of priority and the guide as to the working date which we discussed is as follows: If it is an original or the first adjudica tion which was 1892 and 94 the appropria- tion date is the effective date. If it comes after that original adjudication either the previous adjudication date or the appropriation date is the working date whichever is la ter. For example the Airline Irrigation Ditch appropria tion da te 9/3/1898, adjudicated in 9/21/1898 is senior to the next decree, the Juniper Ditch with an appropriation date of 3/10/1888 because the working date in that instance was 9/21/1898 which would be the earliest date that the next adjudication got. The Juniper Ditch working date for example would be 9/15/1902. One of the things that may be a little bit confUSing to you is that this is just a partial list for that particular wa ter district and there were adjudications in between but apparently there were no Yampa rights entered into those particular adjudications. If you have any questions regarding the above comments or the list, please holler as I would be most happy to clarify to make sure there is no misunderstanding at the time you make your presentation on this particular matter.
