Lindskold, Land and <br />Natural Resources Division, Deparcment of Justice, hereby agree <br />and stipulate as follows: <br /> <br />1. Congress has the constitutional power to create <br />na~ional parks and to authorize the National Park Service to <br />acquire water rights necessary to carry out the purposes of such <br />parks. <br /> <br />2. The fundamental purpose of national parks is to con- <br />serve the scenery and the natural and historic objeccs and the <br />wildlife therein and to provide for the enjoyment of che same in <br />such manner and by such means as will leave them unimpaired for <br />the enjoyment of future generacions. 16 U.S.C. sec. 1 (1916). <br />Rocky Mountain National Park was created for such purpose. 16 <br />U.S.C. sec. 191-198 (1915). <br /> <br />3. Appropriations for the National Park Service are <br />authorized for the investigation and establishment of water <br />rights in accordance with local custom, laws, and decisions or <br />courts, including the acquisition of water rights or of lands or <br />interests in lands or rights-of-way for use and protection of <br />water rights necessary or beneficial in the administration and <br />public use of the national parks. 16 U.S.C. sec. 17j-2(g), <br />(1946). <br /> <br />4. The United States has acquired certain water rights <br />located in Rocky Mountain National Park, which rights were estab- <br />
