A" <br /> <br />DISTRICT COURT, WATER DIVISION NO.1, COLORADO <br /> <br />CASE NOS. 84 CW 426 thru 84 CW 466 <br /> <br />STIPULATION FOR DELETION FROM ABANDONMENT LIST <br /> <br />CONCERNING THE PROTESTS OF THE UNITED STATES OF &~ERICA TO <br />A3A~DONMENT LIST OF WATER RIGHTS AND CONDITIONAL WATER RIGHTS <br />IN WATER DIVISION No.1, INVOLVING WATER RIGHTS IN LARIMER <br />COUNTY (ROCKY MOUNTAIN NATIONAL PARK). <br /> <br />The S~ate Engineer and Division Engineer for Water Division <br />No.1 and the United States of ~~erica, through their attorneys, <br />Duane Woodard, At~orney General for the State of Colorado and <br />John E. Lindskold, Land and Natural Resources Division, De~artment <br />of Justice, res~ectively, hereby agree and sti~ulate as follows: <br /> <br />1. The United States has changed the use of the above-referenced <br />water ~ights from the decreed use to a use conforming with federal <br />land management policies and directives and, therefore, said water <br />rights have not been abandoned; <br /> <br />2. The State Engineer and Division Engineer for Water <br />Division No. 1 agree that the water rights in the above-referenced <br />~ases shall be deleted from the Water Division No. 1 revised <br />1978 abandonment list; <br /> <br />3. The United States of America agrees to file a change of <br />water rights applications on or before December 31, 1985, for <br />each of the above-referenced cases in order to obtain a decree for <br />the present use(s); <br /> <br />4. The United States of America agrees to file change of <br />vater right ~pp1ications at such time as it desires to change <br />the place, manner, or time of use within Rocky Mountain <br />National Park, as decreed under Paragraph 3 above; <br /> <br />s. The United States of America agrees not to use the water <br />rights decreed under Paragraph 3 above outside the exterior boundaries <br />of Rocky Mountain National Park unless otherwise expressly directed <br />by statute; <br />
