See Gomillion <br />v. Lightfoot~ 364 U.S. 339, 342 (1960). <br />In Colorado, agencies have only that authority <br />granted to them by the Legislature. Dixonv. Zick, 179 Colo. <br />278, 284, 500 P.2d 130 (1972); Board of Cot.nty Commissioners <br />v. Love, 172 Colo. 121, 125, 470 P.2d 861 (1970). A Colorado <br />agency is barred from sub-delegating its authority to another <br />body, expressly or impliedly, absent expre.ss legislative <br />authorization. Colorado v. Silverman, Colo. ____, 555 <br />P.2d 1155, 1158 (1976). <br />The Colorado Water Quality Control Act provides <br />that the Water Quality Control Commission is the "State <br />water pollution control agency for this State for all purposes <br />of the federal act,.and is hereby authorized to take all action <br />necessary and appropriate to secure to this State, its <br />municipalities, or intermunicipal or interstate agencies <br />the benefits of said Act." C.R.S. 1973-25-8-202(6) <br />(emphasis added). Consistent with this single State <br />agency approach, the Colorado Water Quality Act provides <br />that the Water Quality Division shall conduct a continual <br />planning process for purposes of section 208 of the federal <br />Act and that the Division shall submit its proposals to the <br />Commission for hearing and approval. C.R.S. 1973, 25-8-703. <br />Nowhere in the Colorado Act is there any authority for 208 <br />plan approval to any other entity or a subentity of the State. <br />Any agreement with any agency of the federal govern- <br />ment "authorizing, or requiring compliance in this State with <br />any water quality standard or control regulation" is not <br /> <br />. -12- <br /> <br />1377 <br />
