REPORT <br />No, 97-422 <br /> <br />1037 <br /> <br />PAPAGO INDIAN CLAIMS <br /> <br />o <br />'" <br />CD <br />o <br /> <br />JANUARY 29. 1982.-Committed to the Committee of the Whole House on the State <br />ofthe Union and ordered to be printed <br /> <br />. <br /> <br />Mr. UDALL, from the committee on Interior and Insular Affairs, <br />submitted the following <br /> <br />REPORT <br /> <br />[To accompany H.R. 51181 <br /> <br />[Including cost estimate of the Congressiona.I Budget Office] <br /> <br />The Committee on Interior and Insular Affairs to whom was re, <br />ferred the bill (H.R, 5118) to provide water to the Papago Tribe of <br />Arizona and its members. to settle Papago Indian water rights <br />claims in portions of the Papago reservations, and for other pur- <br />poses, having considered the same, report favorably thereon with <br />an amendment and recommend that the bill as amended do pass, <br />The amendment is as follows: <br />Strike out all after the enacting clause and insert in lieu thereof <br />the following: <br /> <br />. <br /> <br />CONGRESSIONAL FINDINGS <br /> <br />SECTION 1. The Congress finds that- <br />(1) water rights claims of the Papago Tribe with respect to the San Xavier <br />Reservation and the Schuk Taak District of the Sells Papago Reservation are <br />the subject of existing and prospective lawsuits against numerous parties in <br />southern Arizona, including major mining companies, agricultural interests, <br />and the city of Tucson; <br />(2~ these lawsuits not only will prove expensive and ~ime consuming for all <br />participants, but also could have a profound adverse impact upon the health <br />and development of the Indian and non-Indian economies of southern Arizona; <br />(3) the parties to the lawsuits arid others interested in the settlement of the <br />water rights claims of the Papago Indians within the Tucson Active Manage- <br />ment Area and that part of the Upper Santa Cruz Basin not within that area <br />have diligently attempted to settle these claims and the Federal Government, <br />by providing the assistance specified in this Act, will make possible the execu- <br />tion and implementation of a permanent settlement agreement; <br />(4) it is in the long-term interest of the United States, the State of Arizona. its <br />political subdivisions, the Papago Indian Tribe. and the non-Indian community <br />of southern Arizona that the United States Government assist in the implemen- <br /> <br />89-006 0 <br />
