Giles, Mr. Arvin B. Shaw <br />of California and Governor Hannet.t. of New Mexioo. This Connni t.tee asked <br />Mr. Davis and Mr. Soot.t. for some brief or dat.a oonoerning this applioation <br />for a preliminary permit. Mr. Giles, have you a report to make at this <br />time? <br /> <br />MR. GILES: Mr. Chairman and Gentlemen: About the only funotion <br />that our Committee has performed up to this date is te request a brief <br />from the Arizona represent.atives on this question. Owing to oonditions <br />that have developed over Whioh these gentlemen, of oourse, have had no <br />power to oontrol delays have been oaused. I think that the Arizona <br />representative oould give the det.ails a 1 itt.le bit more accurately than <br />I oould. A:f'ter we have their brief and they state their position maybe <br />we oan agree but, at least, we ought to see the picture as they see it first. <br /> <br />Mr. Davis, oould you enlight.en the Conunittee on the present <br />status of your work along that line? <br /> <br />MR. DAVIS: Mr. Chairman, probably the best thing is to layout <br />the pioture as it now is and as we see it. Perhaps you will reoall at the <br />Denver Meeting that your Legislature hadjust enaoted a new law oreating <br />a oommission., Instead of the commissions all expiring'eoterminous, this <br />one started upon the 1st ef April, being for six years. <br /> <br />That was our first offioial meeting and that 'was on Maroh 9th. <br />Before that, it was just a hold over under the old law. Not knowing what <br />disposition would be made, it was impessible for us to do anything exoept <br />in a way mark time and then take oare of it to the best of our ability <br />under the old setup. <br /> <br />Our first meeting was on March 9th. Under the 'new law it <br />~powers us to employ an attorney if' we see fit to do so. We did that <br />innnediately but owing to tho opposition of our Attorney General who <br />oontested this and brought it up to the Supreme CeuM;, we oould no\; do <br />anything. Just a week ago a decision was hended down 'but before that it <br />was impossible for us to go ahead and prepare a brief. JUdge Shute is <br />here with us teday as our at:torney. He has the legal understanding and <br />st.atus of this affair. <br /> <br />I am sure you understand how impossible it would have been for <br />us to have prepared a brief under the conditions I mentioned beoause we ' <br />may not' have even had an applieation let alone a brief had we gone ahead. <br />However, in tIE meantime, there has been sane things happen whioh will <br />direotly bear upon this question as has been brought out here in the <br />discussion this morning. <br /> <br />Since the Denver Meeting we reported that our Legislature had <br />enacted, the ratification of the oompact with several stipulations. <br /> <br />-:> <br />
