<br />RECEIVE. <br />.IAN 3 1 1997 <br /> <br />. <br /> <br />J Wv\ 1J {( IVPj <br />C uJ (j) <br /> <br />- --" <br /> <br />Colorado V"~t'Jr <br />Conservation B~.Dr..... <br /> <br />SOUTHEASTERN COLORADO WATER CONSERVANCY DISTRICT <br /> <br />RESOLUTION ESTABUSIDNG THE <br />SOUTHEASTERN COLORADO WATER AND STORAGE <br />NEEDS ASSESSMENT ENTERPRISE <br /> <br />WHEREAS, the Board of Directors of the Southeastern Colorado Water Conservancy <br />District ("Southeastern District") has the authority and fmds it is desirable to establish a water <br />activity enterprise pursuant to Article 45.1 of Title 37, C.R.S.; and <br /> <br />WHEREAS, the Southeastern District, the Colorado Water Conservation Board <br />("CWCB"), and various water agencies within the Southeastern District boundaries (the "Local <br />Participants") desire an assessment of future needs for water and water storage for use within the <br />Arkansas River Basin in Colorado (the "Needs Assessment"); <br /> <br />NOW, THEREFORE, BE IT RESOLVED that: <br /> <br />1. The Board of Directors of the Southeastern Colorado Water Conservancy District <br />establishes the Southeastern Colorado Water and Storage Needs Assessment Enterprise (the <br />"Assessment Enterprise"), effective January 16, 1997, <br /> <br />2. The Assessment Enterprise is established for the purpose of pursuing, establishing <br />and continuing water activities as a business, separate and distinct from the Southeastern District's <br />governmental activities and from the existing Southeastern Colorado Water Activity Enterprise <br />("SECW AE"). The business of the Assessment Enterprise shall involve the financing and conduct <br />of the Needs Assessment. The Assessment Enterprises's activities (" Assessment Enterprise water <br />activities") may include, without limitation, planning, engineering, surveys, studies and' <br />development pertaining to water acquisition, use, reuse, storage, augmentation, exchange, supply, <br />distribution and admioistrati(l'1 ~ctivities <br /> <br />3, Pursuant to and in accordance with Article 45,1 of Title 37, C.R,S., the governing <br />body of the Assessment Enterprise shall be the Board of Directors of the Southeastern District, <br />which shall also be the Board of Directors of the Assessment Enterprise. Said Board of Directors <br />shall establish an advisory committee including Board members and Local Participant <br />representatives, to advise the Board in various aspects of the Assessment Enterprise's water <br />activities. <br /> <br />4. The Assessment Enterprise shall be operated as a "water activity enterprise" and <br />shall be entitled to exercise all powers, authorities, rights, and responsibilities it may exercise in <br />accordance with Article 45.1 of Title 37, C.R,S. and other applicable law, except that the <br />
