Based on <br />that review,' conversations with you, and review of applicable legal <br />authority, it is my opinion that: <br /> <br />" <br /> <br />1. <br /> <br />Mayor Frances Green, the person signing the Contract on <br />behalf of the Board of Trustees of the Town of Rangely, <br />is a duly elected official of the Town of Rangely. <br /> <br />2. Mayor Frances Green has the authority to bind the Town of <br />Rangely upon proper resolution of the ~oard of Trustees <br />of the Town of Rangely, and the Contract will be validly <br />approved by the Board of Trustees of the Town of Rangely <br />upon a majority vote in favor of a resolution approving <br />the Contract. <br /> <br />3. The Board of Trustees of the Town of Rangely has the <br />authority to enter into the Contract without a vote of <br />its residents under the powers granted to the governing <br />body of a statutory town pursuant to section 31-15-302, <br />C.R.S., and the Rangely Municipal Code; however, this <br />opinion does not address the requirements of the <br />Taxpayer's Bill of Rights, Colorado Constitution Article <br />X, Section 20 ("TABOR Amendment"). The Town of Rangely, <br />in its capacity as a water activity enterprise, appears <br />to be a water activity enterprise under the provisions of <br />Senate Bill 93-130, codified at section 37-45.1-101, et <br />seq., C.R.S.
