<br />Know all men by ~hese nresents, that we, 0011ins D. Fu11er,Char1es W
<br />Darrow and Thomas J. ~cDermott, residents of the state of Colorado have
<br />associated ourselves together as a corporation under the name and '
<br />style of The r.lenwood Irri~ation Company,for the. purpose of becoming a
<br />body corcorate and politic under and by virtue of the laws of the
<br />"Sta te of Co10rad 0; and in accordance with the provi s ions of the 1a ws
<br />of said State, we do nereby make, execute and acknowledf-e in duplicate
<br />t\1is certificate in writine-: of our intention so to become a body cor-
<br />porate, under and by virtue of said laws.
<br />First. Th$ corporate name and style of our said corporation
<br />shall be The G1enwood Irrigation Company.
<br />Second: The objects for which our said corporation is formed ~nd
<br />incorporated,are for the purpose of acquiring the ownerShip of and the
<br />title to the G1enwood ~prings Ditch,statement whereof was filed in the
<br />office of the clerk and recorder of Garfield county ,Colorado , l~rch
<br />7th, 1901, at 5 45 o'clock p.m. as Document No. 2~,546, to which reference
<br />is hereby made for greater certainty; to keep in repair and maintain said
<br />ditch t~roughout which is to include all expenses needed in keeping said
<br />ditch up and utilizing the same for the purposes for which it is intended,
<br />but not including enlargements thereof nor extensions of the same nor the
<br />construction of auxiliary or collateral works such as reservoirs and
<br />. the like; to acquire all needed and necessary water supply for said
<br />ditch by way of appropriations or otherNise and to procure adjudica-
<br />tions of all. priority rights thereof; to furnish and deliver water
<br />from said ditch along the line thereof, but to the stock-holders in our
<br />said corporation only, for the irrigation of lands lying under said
<br />ditch and for domestic use thereon including the supplying of the town
<br />of G1enwood ~prings, ~olorado, with water for the irrigation of its
<br />shade trees, the irrigation of lawns and the like; to acquire all
<br />needed and necessary rights of way for said ditch by purchase, condemna
<br />~tion 01' other lawful manner; the source ,of water supply for said
<br />ditch is the hoaring1!ork hiver, to be diverted from said ditch at a
<br />point on the Northeasterly side of ,said river at a point 100 feet
<br />further up said river th~n the head-p,ate of the Sharp Ditch which is
<br />located at a point whence the N.1-4 Cor. of Sec.28,Twp.7 S.R.88 W.bears
<br />N.7 degs. and 28 mins. E.2,159 ft. as appears from Document No.20,140 on
<br />fiie in the office of the clerk and recorder of said varfie1d county,
<br />and from thence said ditch extends in a general no~thwester1y direc-
<br />tion to Cattle ~reek and in the alignment of said ~harp ~itch so far
<br />as it has been con~tructed, and as shown in said Document No.20,140,and
<br />at Cattle creek the water from the ditch in qUEstion to be acquired by
<br />this company as aforesaid,is emptied into the bed of said creek and
<br />is to flow down in said bed to the present head-gate of the G1enwood
<br />Ditch statement and map of Which is on file in said recorder's office
<br />as uocument No. 5,850 to which reference is hereby made, and there to-
<br />/Zether with all -..;aters arising from springs in the bed of or near said
<br />Cattle creek, a short distance above this head_p,ate of the Glenwood
<br />Ditch, the water so turned or emptied into said creek, is to be tur~ed
<br />into said G1enwood nitch as enlarged and restored, and conducted there-
<br />in and in a1ig~~ent-thereof to its end as shown in said Document Xo.
<br />5 850 and as constructed on the ground and as the same will be enlarg-
<br />eA and restored,. and from the end of said G1enwood Ditch a new ditch is
<br />to be made following tr,e most eligible route to the town of v1enwood
<br />Springs at or near the ~ast line of5ec. 9,Twp.6 S.H.89 W., where this
<br />ditch so to be acquired as aforesaid, ends, and which follows the align-
<br />ment of said G1enwood Ditch from Co.': .. "~~ "5 construct-
