<br />PROJECT CONTRACT
<br />
<br />
<br />THIS CONTRACT is made this~ day Of0fl.l!lA ^~, 1994, by and
<br />between the State of coloradofur the. ~nefit of the
<br />Department of Natural Resources (Colorado Water Conservation
<br />Board), hereinafter referred to as the State, and the City of Fort
<br />Lupton and the Fort Lupton Water Utility EnterpriBe, P.O. Box 148,
<br />Fort Lupton, Colorado, 80621, hereinafter referred to as the
<br />Contractor or Borrower.
<br />
<br />WHEREAS, authority exists in the Law and Funds have been
<br />budgeted, appropriated and otherwise made available and a
<br />sufficient unencumbered.lM:J-iince thereof remains available for
<br />Rfffll}l'pt in Fund Number~, Appropriation SlS/5/, Organization
<br />/,Y1Y, Program YV~C)Contract Encumbrance Number, C/~~tty; and
<br />
<br />WHEREAS, required approval, clearance and coordination has
<br />been accomplished from and with appropriate agencies; and
<br />
<br />WHEREAS, pursuant to the provisions of s37-60-119, Colorado
<br />Revised Statutes, the State is authorized to loan and grant money
<br />for the construction of water projects for the benefit of the
<br />people of the State of Colorado; and
<br />
<br />WHEREAS, the City of Fort Lupton lS a statutory city in Weld
<br />County in the State of Colorado; and
<br />
<br />WHEREAS, pursuant to C.R.S. S 37-45.1-101 et seq., the
<br />Northern Colorado Water Conservancy District, hereinafter referred
<br />to as NCWCD or the District, organized the Northern Colorado Water
<br />Conservancy District Southern Water Supply Project Activity
<br />Enterprise, hereinafter referred to as the SWSP Enterprise, as a
<br />government-owned business within the meaning of Article X, Section
<br />20(2) (d), of the Colorado Constitution, by resolution of the NCWCD
<br />Board of Directors dated August 13, 1993 and attached hereto as
<br />Appendix A; and
<br />
<br />WHEREAS, the SWSP Enterprise is developing the Southern Water
<br />Supply Proj ect, hereinafter referred to as the Proj ect, which
<br />consists of modifications to the existing Carter Lake Dam No. 1
<br />Outlet Works and replacement of a portion of the St. Vrain Supply
<br />Canal and related work, together with pipeline segments to deliver
<br />raw water from existing water supplies available at Carter Lake to
<br />the City of Broomfield and planned connecting pipelines to deliver
<br />
