<br />~., '" ~ <br /> <br />RESOLUTION NO. 93-27 <br /> <br />A RESOLUTION RECOGNIZING THE EXISTENCE OF THE WATER UTILITY <br />ENTERPRISE OF THE CITY OF FORT LUPTON, COLORADO. <br /> <br />WHEREAS, the City of Fort Lupton is a statutory city in the <br />State of Colorado with the city Council as its governing body; and <br /> <br />WHEREAS, the city, pursuant to its statutory authority and <br />pursuant to its own ordinances, code, rules and regulations, has <br />owned and operated a Water utilities Enterprise, consisting of the <br />acquisition of water and water rights, the construction, operation, <br />repair and replacement of water facilities to obtain raw water for <br />treatment and deliver treated water for residential, commercial and <br />industrial use; and <br /> <br />WHEREAS, it is of benefit to the city and its citizens that <br />this Water Utilities Enterprise be acknowledged and recognized as <br />such within the meaning of Article X, section 20(2) (d) of the <br />Colorado Constitution and Section 37-45.1-101 et. seq. C.R.S. and <br />other applicable statutes; and <br /> <br />WHEREAS, the city has embarked on a new and expansive project <br />to acquire raw water from the Northern Colorado Water Conservancy <br />District, through the Southern Water Supply proj ect, to improve the <br />quality of the raw water for its Water Utilities Enterprise; and <br /> <br />NOW THEREFORE be it resolved by the city council of the city <br />of Fort Lupton, Colorado as follows: <br /> <br />The existing Water utility Enterprise of the City of Fort <br />Lupton, Colorado is hereby formally recognized as a government- <br />owned and operated business pursuant to the authorities cited above <br />and Chapter 13 of the Fort Lupton Municipal Code and by and through <br />its governing body continues to be authorized to issue its own <br />revenue bonds, and shall continue to acquire water and water <br />rights, and continue the construction, operation, repair and <br />replacement of water facilities to obtain raw water for treatment <br />and deliver treated water for residential, commercial and <br />industrial use.
