In the event any conflict arises as to the manner in which the project <br />is to be constructed, the Plans and Specifications will control. <br /> <br />3. Chanl!:e Orders. The Association, without invalidating the contract, may order <br />changes in the work consisting of additions, deletions, or modifications, the guaranteed <br />maximum costs, if any, and the contract time being adjusted accordingly. Such changes in the <br />work shall be authorized by written change order signed by the President of the Association or <br />the Association's designated representative and Evergreen. Oral requests for changes in work <br />will not be considered. Additionally, no individual lot owner may approve any changes in work <br />which varies from the Plans and Specifications unless the change order procedures described in <br />this paragraph are followed. The Association shall have no liability for any change order not <br />first approved in writing by the Association. <br /> <br />The Association acknowledges the need for one additional sleeve and road cut across the <br />County road. Except for these two potential problems, Evergreen bears the risks on any change <br />order not previously approved as described above. <br /> <br />4. Location of Easements. Evergreen understands that an easement was recorded <br />on July 13, 1994, in Book 908 at Page 632 as Reception No. 465802 in the records of the Clerk <br />and Recorder of Garfield County, Colorado, and in Book 648 at Page 168 as Reception No. <br />544209 in the records of the Clerk and Recorder of Eagle County, Colorado, for the purposes <br />of this project and agrees that said project, to the extent located outside the Kings Row <br />Subdivision, will be located within the parameters of the easement, the description of said <br />easement being: <br /> <br />An easement for the purpose of construction and maintenance of an irrigation <br />pipeline, said easement being 20.00 feet in width lying 10.00 feet on each side <br />of the following described centerline, said easement being situated in the <br />Northwest 1/4 Southeast 1/4, Section 21, Township 7 South, Range 87 West of <br />the 6th P.M., Eagle County, Colorado, and in the Northeast 1/4 Southwest 1/4 <br />of said Section 21, Garfield County, Colorado, said easement centerline being <br />more particularly described as follows: <br /> <br />Beginning at a point from which the Southwest Comer of said Northwest 1/4 <br />Southeast 1/4 of said Section 21 bears South 01052'35" West a distance of <br />1230.55 feet, said Southwest Comer being monumented with a rebar and plastic <br />cap B.L.S.
