RECO~DEi( <br /> <br />RESOLUTION OF BOARD OF DIRECTORS OF <br />KINGS ROW HOMEOWNERS ASSOCIATION <br /> <br />~" I ~ <br />ttrE i-' <br /> <br />!I 20 M,' T <br /> <br />J <br /> <br />WHEREAS, the Kings Row Subdivision No. 1 and No. 2 is an <br />approved subdivision located in Garfield and Eagle Counties as <br />shown on the recorded plat thereof recorded in the Office of the <br />Clerk of Garfield County, Colorado, on April 20, 1976, as <br />Reception No. 272247 and on August 24, 1978, as Reception No. <br />287943 and in the Office of the County Clerk of Eagle County, <br />Colorado, on September 6, 1977, as Reception No. 155774 in Book <br />259 at Page 431 and on March 6, 1979, as Reception No. 179414 in <br />Book 283 at Page 008; and <br /> <br />WHEREAS, the Amended Protective Covenants for the Kings Row <br />Subdivision have heretofore been recorded in the Office of the <br />County Clerk of Garfield County on May 12, 1978, as Reception <br />No. 285181 in Book 509 at Page 275 and in the Office of the <br />County Clerk of Eagle County, Colorado, on May 12, 1978, as <br />Reception No. 166543 in Book 270 at Page 152; and <br /> <br />I <br />I I <br />, I <br />- <br />- <br /> <br />WHEREAS, Paragraph 36 of said Amended Protective Covenants <br />provide for amendments to the Protective Covenants upon the exe- <br />cution of a written instrument by the owners of a majority of <br />the lots then subject to these Covenants; and <br /> <br />WHEREAS, the Kings Row Subdivision consists of Lots 1 <br />through 49, inclusive; and <br /> <br />WHEREAS, a Petition for Amendment of Protective Covenants <br />for the Kings Row Subdi vis ion amendi ng Paragraph 19 of the <br />Protective Covenants was submitted by the lawful owners of Lots <br />1, 4, 5, 10, 12, 13, 14, 16, 18, 21, 22, 23, 27, 29, 30, 31, 32, <br />33, 34, 38, 39, 40, 41, 42, 44, 46, and 49; and <br /> <br />WHEREAS, said owners petitioning for amendment owned 27 of <br />the 49 lots wi thin the Kings Row Subdi vi s ion and, therefore, <br />constitute approximately 55 percent of the lots within the'sub- <br />division. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF <br />THE KINGS ROW SUBDIVISION THAT: <br /> <br />1. Paragraph 19 of the Amended Protective Covenants be <br />amended to read as follows: <br /> <br />19. "Primary Structures" Permi tted: "Primary struc- <br />ture" shall mean any enclosed structure which occupies <br />more than eighty (80) square feet in area or more than <br />six hundred (600) cubic feet in volume. The primary <br />structures permitted on any single parcel shall consist <br />of no more than one (1) single-family dwelling house <br />wi th an interior living floor, area of at least one <br />thousand five hundred (1,500) square feet exclusive of <br /> <br />-1- <br />
