As you recall, we <br />represent The Northern Trust Company as Trustee of the F Quar1;er <br />Circle Ranch for the' benefit of the Seyfried Family (Mrs. Anne <br />Seyfried, Mr. Robert J. Seyfried and Mr. Ross Seyfriedl. As we <br />discussed, The Northern Trust Company, as such Trustee, has leased <br />the entire output of three wells in the Hay Gulch Alluvium to MCQWD <br />for approximately the last 15 years as MCQWD'sprimary source of <br />high-quality water for its cu~tomers. During that same span of <br />time, MCQWD has also leased the entire output of a fourth Hay Gulch <br />well owned by an adjoining property owner, Dr. Beaghler, and 1che <br />leases on all four wells were recently extended for several <br />additional years by mutual consent. In addition, a nearby fifth <br />well owned by the State Board of Land Commissioners has been leal5ed <br />by MCQWD for a term of years, <hough we are not as familiar with <br />the details of that lease as we are with the Northern Trust and <br />Beaghler leases. <br /> <br />When we discussed this matter on November 10, you <br />enumerated eight conditions that the Board would insist be met <br />before final loan approval could be considered. Among th'i~se <br />conditions was an affirmative determination of economic <br />feasibili ty, which you explained would essentially require that <br />MCQWD prove that the present lease arrangements are either <br />insecure, or somehow could be underpriced by an extension of t.he <br />SWSP pipeline from its presently planned Hudson terminus.
