<br />- <br /> <br />. <br /> <br />Page 3 Minutes # 507 <br /> <br />Decision on the appeal will take approximately thirty <br />which will go into the first of August; a decision from <br />Appeal Board should be given at the August Board meeting. <br /> <br />days, <br />the <br /> <br />It is possible that since a new State Director will be named <br />for BLM, the decision could be reverted back to the new Director <br />for another decision. <br /> <br />The Chairman reviewed for the new Board Members the issue of <br />the ponds that are on Ute Water's 'Healy Property', these ponds <br />have been offered to BLM for use for recreation purposes. The <br />issue of the ponds will be included in the BLM appeal. <br /> <br />EBune l!2!2Us <br /> <br />The Manager reported work is continuing with the Attorneys <br />on the Fruita issue, at present no new information on the issue <br />other than, the contact with Mayor Pollock expressing that the <br />Ute Board will need to consider some strong and fixed and firm <br />measures in hopes that Fruita and Ute could get together in <br />negotiating the issue. Fruita has requested the Colorado Water <br />Conservation Board to take all or part of the $800,000.00 debt <br />in which Ute received in the taking over of the Fruita water <br />system and put into a grant; Mayor Pollock expressed that was <br />the delay on Fruita's part on waiting on Colorado Water <br />Conservation Board's reply on the request. <br /> <br />The Manager requested that a meeting was needed to be held <br />with the Executive Committee the week of June 16th, this meeting <br />is to review information from Ute's Attorney Scott Balcomb on what <br />the cost figure consist of for the customers in the City of <br />Fruita. <br /> <br />The Chairman ask if any information was known on the Pinon <br />Mesa water on the recreation plan? Wallace Downer reported that <br />a couple of meetings have been held and another meeting was <br />scheduled for June 17, 1986 at 7:30 P.M., the results of this <br />recreation plan is approaching the final stages. Wallace Downer <br />expressed to the Board that Ute should attend these meetings if <br />the Pinon Mesa water was of interest to Ute. The Manager stated <br />that he had been in contact with the Mayor and the Mayor had not <br />encouraged Ute to be present at these meetings. <br /> <br />The Manager reported that Ute has not been on the <br />list for notification of these meeting. <br /> <br />mailing <br /> <br />After discussion by the Board on Ute's interest in <br />Water, Wallace Downer pointed out to the Board that it <br />in the contract agreement that Ute will have a right <br />refusal concerning Fruita's water rights. <br /> <br />the Pinon <br />is stated <br />of first <br />
