<br />Form 6.AC.02A <br /> <br />L I ./ DEP~~ENT OR AGENCY NUM <br />34- 04- 00 <br />CONTRACT ROUTING NUMBER <br />5497 <br /> <br />- II $1,000 <br />~~ CONTRACT <br /> <br />S CONTRACT, made this 1st day of Ju1v 197..s.. by and between the <br />Sta 0 Colorado for the use gnd benefit of the Department of '1 Natural Resources <br />c; (CoLorado Water Conservat1.on Hoard) <br />. hereinafter referred to as the S1ate and '2 Sage - Burne tt <br />, 8th and 8th Building, Su~te 203, Greeley, Colorado ~Ob3l <br />hereinafter referred to as the contractor, <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unyncumbered balance thereof remains available for payment in Fund Number 4008, <br />G/L Account Number5220 7 ,Contract Encumbrance Number C15110? ; and <br /> <br />WHEREAS, required approval. clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br /> <br />WlIEREAS, '] pursuant to the provisions of 37-60-119, Colorado Revised <br />Statutes 1973, as amended, the Colorado Water Conservation Board is <br />authorized to construct certain water projects for the benefit of <br />the people of the state of Colorado; and <br /> <br />WHEREAS, the Larkspur Homeowners Association has made application <br />to the Colorado Water Conservation Board for the construction of a <br />water project for the purpose of improving its municipal water supply; <br />and <br /> <br />WHEREAS, the Contractor is a professional engineering firm <br />within the state of Colorado and has previously done considerable <br />water related work for various other communities in Colorado. <br /> <br />NOW THEREFORE, it is hereby agreed that: <br /> <br />1. The Contractor agrees to prepare a feasibility report directed <br />to the problem of improving the municipal water of the <br />Larkspur Homeowners Association in accordance with a proposal <br />for project feasibility report prepared by the Contractor <br />and approved by the Colorado Water Conservation Board, <br />received June 6, 1978, which proposal is attached hereto as <br />Appendix A and made a part of this contract. <br /> <br />2. Fifteen (15) copies of the report called for in this contract <br />shall be furnished to the State not later than September 30, <br />1978, unless such time is extended by mutual agreement of the <br />parties hereto. <br /> <br />3. <br /> <br />As compensation for the services of the <br />agrees to pay the Contractor the sum of <br />(~1,000) in the manner following: <br /> <br />a. Ninety percent (90%), to wit Nine Hundred Dollars ($900) <br />of the total amount due in one installment on August <br />30, 1978. <br /> <br />Contractor, the State <br />One Thousand Dollars <br /> <br />b. The remaining ten percent (10%), to wit, One Hundred Dollars <br />within thirty (30) days following receipt and acceptance <br />of the written report specified in paragraph 2 of this <br />contract. <br /> <br />4. This contract is personal in nature and assignment of performance <br />by the Contractor to another is prohibited unless prior approval <br />in writing is granted by the State. <br /> <br />5.
