<br />
<br />THIS CONTRACT, made this ;gttt day of _1)& EM AER 2000, by and
<br />between the State of Colorado for the use and benefit of the Department of Natural
<br />Resources, Colorado Water Conservation Board, hereinafter referred to as the CWCB
<br />and/or STATE, and the City of Idaho Springs, Colorado, acting by and through the City of
<br />Idaho Springs, Colorado, Water Enterprise hereinafter referred to as the BORROWER and/or
<br />CONTRACTOR, P.O. Box 907, Idaho Springs, Colorado S0452.

<br />FACTUAL RECITALS
<br />
<br />1. Authority exists in the law, and funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains available for payment in
<br />Fund Number 424, Organization YYYY, Appropriation L9S, GBL IDAH, Program WTRC,
<br />Object Code 5510, Reporting Category: 0016, Contract Encumbrance Number C150016.
<br />
<br />2. Required approval, clearance, and coordination have been accomplished from and with
<br />appropriate agencies.
<br />
<br />3. Pursuant to the provisions of ss 37-60-119 and 37-60-120, C.R.S. (1999) the STATE is
<br />authorized to loan money for the construction of water projects for the benefit of the people of
<br />the State, provided that the borrower assures repayment of that money.
<br />
<br />4. The Cily of Idaho Springs, Colorado ("CITY") is a statutory city pursuant to Section 31-1-
<br />203, C.R.S. (1999), located in Clear Creek County, State of Colorado.
<br />
<br />5. The BORROWER is an enterprise within the meaning of S 37-45.1-101 et seq., C.R.S. (1999)
<br />and Article X, Section 20 of the Colorado Constitution, created pursuant to Resolution No. 12,
<br />Series 1995 of the City Council of the CITY dated December 29, 1995, which is incorporated
<br />herein by reference.
<br />
<br />6. The BORROWER applied to the STATE for a loan to be used for a major rehabilitation of the
<br />Idaho Springs Reservoir, hereinafter referred to as the PROJECT, at an estimated total cost of
<br />$1,100,000.
<br />
<br />7. The BORROWER has previously received a short term CWCB emergency loan in the amount
<br />of $130,000 to make repairs to the Chicago Creek Reservoir and the CITY'S raw water intake
<br />on Chicago Creek.
<br />
<br />8. The STATE has reviewed a feasibility report on the PROJECT compiled by Parson's
<br />Engineering Science Inc., which is incorporated herein by reference, and based upon this
<br />feasibility report, the STATE determined the PROJECT to be technically and financially feasible.
<br />
<br />9. At its November 1997 meeting, the CWCB approved a loan to the BORROWER in an amount
