Box 21 <br />Cedaredge, CO 81413 <br />970-856-3029 <br />John Eric Niblack is an individual acting as the sole proprietor <br />of the Four Seasons T~out Farm <br /> <br />Phone Number: <br />Type of Entity: <br /> <br />Section 2 - Project Description <br /> <br />A. Description of PROJECT: The BORROWER applied to the CWCB for a loan to <br />rehabilitate the fish hatchery to eliminate whirling disease in accordance with HB <br />01-1024. The rehabilitation will consist of reconstruction of the hatchery raceways <br />including predator control and .rehabilitation of the source water collection system <br />and hatchery building. The trout farm is located in Delta County, hereinafter <br />referred to as the PROJECT, at an estimated total cost of $97,945. <br /> <br />B. Description of Feasibility Study: The CWCS has reviewed a feasibility study report <br />on the PROJECT consisting of the completed plans and specifications completed for <br />by McMillon Engineering of Ridgway and those plans were independently evaluated <br />by the Colorado Division of Wildlife and found to be adequate in terms of <br />constructability and maintenance required to aVoid the recurrence of whirling <br />disease. The eWCB assisted with the preparation of a feasibility study in <br />accordance with CWB guidelines and, based upon the, report, the CWCS <br />determined the PROJeCT to be techniC8l1y and financially feasible. <br /> <br />SecTIoN 3 - CWCB's AUTHORITY <br /> <br />Construction Fund: Pursuant to the provisions of ss 37-60-119 and 37-60-120, C.R.S. the <br />ewcs is authorized to loan money for water projects from the CWCB Construction Fund <br />, for the benefit of the people of the State, provided that the borrower assures repayment of <br />that money. <br /> <br />House Bill 01-1024, Section 1, provides that pursuant to S 37-60-122, C.R.S., the CWCS is <br />authorized to loan money to enabie commercial aquaculturists, whose aquaculture facilities <br />are fish production facilities that test positive for myxobolus cerebralis ("whirling disease") to <br />make any such facility achieve a negative whirling disease certification, or prevent the <br />introd~ction of whirling disease to any aquaculture facility or prevent the spread of whirling <br />disease. . <br /> <br />SeCTION 4 - BOARD APPROVAL. AND LeGISLATIVE AUTHORIZATION (IF NeEDED) <br /> <br />A. At its March 21, 2002, meeting, the CWCB approved a loan to the BORRoweR in an <br />amount up to $85,500, at an interest rate of 2.25% per annum for a repayment term <br />of 10 years. <br /> <br />Appendix 1 to Loan Contract C150110 <br />
