(Updated November 29, 1996) <br />November 25, 1996 <br /> <br />3 <br /> <br />sale of water to the Association members, a certificate of deposit account in the <br />amount of one annual payment to be held by the state Treasurer, and the project <br />itself. <br /> <br />Action Taken bv the CWCB. November 25.1996 <br /> <br />The CWCB was concerned about the following issues: <br /> <br />1. The 404 permitting procedure for construction of the diversion, and the issue of new <br />depletions in the basin. (This may not be a serious issue, since annual depletions for this <br />project would be less than 100 acre feet, based on proposed use within the service area.) <br /> <br />2. Whether the Federal Clean Water Act would allow this type of rural domestic water <br />system, where the individua110t owners treat their own water. (This could be resolved <br />by revising the project to a raw water irrigation system.) <br /> <br />3. The issue of overlap with the Pine River Irrigation DistrictlVallecito Water Company <br />rural domestic system. (This could be resolved by revising the Pinion Mesa project to <br />a raw water irrigation system.) <br /> <br />4. The specific rate schedule (tap fees and water sales), which will be necessary to pay <br />for operation, maintenance, capital replacement, and debt service on the CWCB loan. <br /> <br />5 . Conceptual designs and an engineering cost estimate are needed. <br /> <br />For the above reasons, the CWCB did not approve the staff recommendation, but set the <br />loan for follow-up discussion at the January 29-30, 1997 Board meeting. In addition, the <br />CWCB approved a $5,000 grant to the Pinon Mesa Ranches Community Association <br />to fund a Feasibility Study for the project. The grant is to be funded from the <br />Operational Account of the Severance Tax Trust Fund. <br /> <br />To obtain the grant, 'the Association will need to hire a Consulting Engineer, and have <br />the plan of study approved by the CWCB staff.
