Llle, Director <br />Colorado Water ConsclVation Board <br />1313 Shennan Stroot, Room 721 <br />Denver, CO 80203 <br /> <br />Re: Norwood Water Commission Feasibility Report Contract for $320,000 (the "Contract") between <br />the State of Colorado, the Town of Norwood (the "Town") and tile Norwood Water Commission <br />(the "Commission") <br /> <br />Dllar Chuck: <br /> <br />Concerning the Contract, it is my opinion that: <br /> <br />1. <br /> <br />the signatures of the persons signing for the Town and the Commission (together Ihe "Entities") <br />are lhose of officials duly elected or appointed, <br /> <br />I. <br />I <br />I <br /> <br />2. <br /> <br />the persons signing 1'01' the Emilies have the authority to bind Ihe Entities and the COlllrael has <br />been validly approved by the Entities' governing bodies. <br /> <br />3. the governing bodies of !he Entities have tM aulhority to enter illlo Ihe eonlract without a vOle <br />of the residents Of the Entities. The Contrdct is not subject 10 the provisions of lhe Colorddo <br />Constitution, Article Xl, ** I and 6 because tile Entities are not pledging the "eredil or faith <br />thereof' of lhe Entities (~ 1) and will not secure their loan under the Comraet with "general <br />obligation debt" (s 6).
