<br />e <br /> <br />. <br /> <br />Memorandum <br />August IS, 1995 <br />Page Three <br /> <br />Currently the deficit amounts to about 23 acre-feet during the winter months which is roughly <br />equal to the capacity of the existing raw water reservoir. Norwood presently has a tap <br />moratorium with a large backlog of applications. It is expected that winter demands would <br />quickly exceed raw water storage capacity when the tap moratorium is lifted. <br /> <br />Conclusions <br /> <br />The 60 shares in the FWDC presently owned by Norwood plus the recently-acquired 50 <br />shares gives the NWC a total of 110 shares. Assuming again a dry-year yield of one acre- < <br />foot per share would result in an estimated firm yield of 110 acre-feet from Norwood's <br />interest in the FWDC. This is slightly less than the combined capacities (125 acre-feet) of <br />the existing and proposed reservoirs. In other words, the 110 shares of FWDC water would <br />essentially provide a full supply for the project with some storage space left for future <br />expansIOn. <br /> <br />While most of the water rights in the FWDC are decreed for irrigation use, one or more of <br />the storage rights are decreed for domestic use. Norwood has been using its shares for <br />municipal purposes since 1964 and 1976 based on the information in Table IV-I of the <br />feasibility study. It should also be noted that Section 19 of the Bylaws of the FWDC states <br />that "all waters impounded in or carried through the ditch and reservoir system of the <br />Farmers' Water Development Company shall be used only for domestic purposes and to <br />irrigate lands." <br /> <br />Based on a detailed review of the information in the feasibility report and on having spent <br />more than a year working closely with the project sponsor and the engineering consultant, it is <br />my professional opinion that this project is technically, economically, and financially feasible. <br />I further believe that a legal opinion at this time regarding the FWDC shares is unnecessary <br />and could, in fact, be counterproductive to any future efforts to encourage cooperation <br />between the FWDC and Norwood. <br /> <br />Attachments <br />cc: Bill Stanton <br /> <br />WEG <br /> <br />Nonnem2. <br />
