WHEREAS. pursuant to the provisions of section 37-60-119.
colorado Revised Statutes. as amended. the State is authorized
to construct certain water projects for the benefit of the
people of the State of Colorado; and

WHEREAS. the North Fork Water Conservancy District has made
application to the State for the repairs Of its existing Lone
Cabin Dam. such improvement is hereinafter sometimes referred
to as the project: and

WHEREAS. the Contractor lS a Water Conservancy District
within the State of Colorado;

NOW THEREFORE. it is hereby agreed that:

1. The Contractor shall have a feasibility report prepared
and directed to the problem of improving the facilities of the
District in accordance with the Memorandum of Agreement for a
project feasibility report prepared by the conSUlting
engineering firm of Ute Engineering and Surveying Company (the
Consultant) and approved by the State. dated September 19.
1986. which is attached hereto as Exhibit A and made a part of
this contract.

2. Fifteen (15) copies of the final report called for in
this contract shall be furnished to the State not later than
January 15. 1987, unless such time is extended by mutual
agreement of the parties hereto in writing.

3. As compensation for the services of the Contractor. the
State shall pay to the Contractor the sum of Two Thousand Three
Hundred Twenty-Five Dollars ($2.325) in the manner following:

a. Sixty percent (60\), to wit. One Thousand Three Hundred
Ninety-Five Dollars ($1.395) of the total amount due in one
installment on January 2. 1987.

b. The remaining forty percent (40\). to wit. Nine Hundred
Thirty Dollars ($930) within forty (40) days fOllowing
receipt and acceptance of the written report specified in
paragraph 2. of this contract.

4. The total cost of services to be rendered for the
Contractor by the Consultant is Four Thousand Six Hundred Fifty
Dollars ($4.650) and the Contractor shall pay the sum of Two
Thousand Three Hundred Twenty-Five Dollars ($2.325) as agreed
to by the Memorandum of Understanding. dated September 29.
1986. which is attached hereto as Exhibit B and made a part of
this contract; and in no event shall this payment be the
liability of the State of Colorado.
