3i <br />• • <br />,.�,�•,ed <br />� �����,��e�e�ce• j <br />e <br />ONSERVANCY DISTRICT RESOLUTION <br />�h� � <br />�ntp/ <br />WHEREAS, the Board of Duectors of the Silt Water Conaervancy Dishict desirea <br />to establish a Water Activity Enterprise pwsuant to C.RS. 37-45.1-101, et seq.; and <br />WHEREAS, the Boazd of Directors of the District desires to eetabliah criteria and <br />conditions related to the Water Activity Ente:prise; and <br />WHEREAS, it is in the best interest of the Disirict and its constituents to estabiiah <br />a Water Acrivity Ente�priae and criteria and conditions relaced to the operation thereof. <br />NOW TT the Boazd of Direcwrs of the Silt Water Conservancy <br />District, having duly. considered this matter, it is: RESOLVED, the Diatrict hereby <br />establishes a Water Activity Entetprise to be operated as followa: <br />(1) The S�7t Water Conservancy I?isirict Water Activity Entc�prise is <br />established for the purpose of any and all aspects of water rights <br />acquisition, water supply project developmem, divecsioq storage, cazriage <br />and delivery, and treatment of water, wastewater and stoan water; <br />(2) Enterprise revenue ahall be from the i�suance of ita own bonds, execution <br />of notes, income from operations, or any other manner of compliance with <br />C.RS. 37-45.1-101, et seq.; <br />(3) The Silt Water Conservancy District Water Activity Enterprise shall not <br />levy any tax which is subject to an Article 10, Secbon 20(4) vou of the <br />electorate, nor shall the ente�prise receive 10% or more of its annual <br />revenue in grants from state or local govemment; <br />(4) The Silt Water Conservancy Diahict Water Activity Enteiprise sLall and <br />hereby does establish an enteiprise fund w account for Water Activity <br />Ente�prise revenues and expenditures; <br />(5) Silt Water Conservancy Diahict Water Activity ErUergrise shall be <br />prohibited from levying azry tax which is subject to a TABOR vote or <br />entering into any general obligation of the local govemment without a <br />vote; <br />(6) Ti�e Silt Water Conservancy District Water Activity Entetpriae is hereby <br />authorized to use all legal authority available to such Water Activity <br />Enterprise under C.R.S. 37-45.1-101, et seq.; <br />(7) The Water Activity Enteiprise is wholty owned by the Silt Water <br />Conservancy District; and ' <br />
