BORROWER: SILT WCD Contract No. C150135 Agency Name: Water Conservation Board Agency Number PDA Routing Number: 05 PDA � �!� � 3 LOAN CONTRACT AMENDMENT NO. 1 (STANDARD CONTRACT — WAIVER #160 — APPROVED NOVEMBER 1 O; 2003) This Amendment, made this October 1, 2004, by and between the State of Colorado for the use and benefit of the Department of Natural Resources, Colorado Water Conservation Board ("CWCB"), and Silt Water Conservancy District acting by and through the Silt Water Conservancy District Water Activity Enterprise, P. O. Box 8, Silt, Colorado 84652 ( "BORROWER" oC "CONTRACTOR"). FACTUAL RECITALS A. Authority exists in the law, and funds have `been budgeted, appropriated, and otherwise made available for payment in Contract Encumbrance Number C150135, Fund Number 424, Appropriation Code MC3, Organization YYYY, GBL S135, Program WTRC, Object Code 5560, Reporting Category 0135. B. Required approval, clearance, and coordination have been accomplished from and with appropriate agencies. , C. The CWCB and the BoRROwER entered into Contract Encumbrance Number G150135, dated June 1, 2003, (" ORIGINAL CONTRACT" incorporated herein by reference, wherein the CWCB agreed to loan money in the total amount up to $490,860, and the BoRROwER agreed to repay the loan in accordance with the terms of the ORi�itva� CotvTRacr. D. The Project consists of replacing the transformer for the pumping plant that delivers approximately 4,000 acre-feet per year from the Colorado River to the Pump Canal, and the replacement must be coordinated by Excel Energy who has postponed its transmission line voltage upgrade until 2007. The BoRROwER therefore requests that the time for completion be extended to 2008. E. The CWCB has reviewed the BORROWER request and has agreed to amend this contract extend the time for completion of the project to December 31, 2008. NOW THEREFORE, it is hereby agreed that 1. Consideration for this Amendment to the ORi�iNa� CoNTwacT consists of the payments that shall be made pursuant to this Amendment and the ORi�iNa� CoNrRacr and the promises and agreements herein set forth. 2. It is expressly agreed by the parties that this Amendment is supplemental to the ORi�iNa� CoNTR,o,cT and all terms, conditions, and provisions thereof, unless specifically modified herein, are to apply to this Amendment as though they were expressly rewritten, incorporated, and included herein. 3. The CWCB agrees that it shall extend the time for completion Of th2 BORROWER Project to December 31, 2008. 4.
