<br /> <br />~- <br /> <br />AGENCY NAME: Water Conservation Board <br /> <br />AGENCY NUMBER: PDA <br />ROUTING NUMBER: 0 ( Olov <br /> <br />CON T RAe TAM END MEN T No.1 <br /> <br />THIS AMENDMENT, made this 2JJ[ day of ApJ21 L- 1998, by and <br />between the State of Colorado for the use and benefit of the Department of Natural <br />Resources, Colorado Water Conservation Board (CWCB), hereinafter referred to as the <br />STATE, and The Town of Hudson and the Hudson Water Fund Enterprise, P.O. Box 351, <br />Hudson, Colorado 80642, hereinafter referred to as the CONTRACTOR. <br /> <br />FACTUAL RECITALS <br /> <br />A. Authority exists in the law, and funds have been budgeted, appropriated, and <br />otherwise made available and a sufficient unencumbered balance thereof remains <br />available for payment in Fund Number 424, Appropriation Code 444, Organization <br />YYYY, Contract Encumbrance Number C153663. <br /> <br />B. Required approval, clearance, and coordination have been accomplished from and <br />with appropriate agencies. <br /> <br />C. The STATE and the CONTRACTOR entered into a contract dated March 2, 1994, <br />Contract Encumbrance Number C153663, hereinafter referred to as ORIGINAL <br />CONTRACT, incorporated herein by reference, wherein the STATE agreed to loan money <br />in the total amount of $1,273,000, and the CONTRACTOR agreed to, repay the loan in <br />accordance with the terms of the ORIGINAL CONTRACT. <br /> <br />D. The PROJECT described in the ORIGINAL CONTRACT was substantially completed as of <br />January 1, 1997. <br /> <br />E. The parties have agreed that, in accordance with Paragraph B.6 of the ORIGINAL <br />CONTRACT, the interest that accrued during construction of the Project in the amount <br />of $45,622.88 shall be added to the principal loan amount. <br /> <br />F. The CONTRACTOR SUbsequently made a payment of $48,203.25 on January 23, 1997, <br />which was applied to the principal amount of the loan. <br /> <br />G. The parties mutually agree to amend the ORIGINAL CONTRACT to establish the final <br />loan amount and the amount of the annual payment. <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. Consideration for this Amendment to the ORIGINAL CONTRACT consists of the payments <br />which shall be made pursuant to this Amendment and ORIGINAL CONTRACT and the <br />promises and agreements herein set forth. <br /> <br />2.
