The State agrees that nuring the <br />pendency of this contract and as long as the <br />Contractor is not in breach, it will allow the <br />Contractor to ~e water represented by those water <br />rights. Convey any shares of stock in the Redlands Water <br />and Power Company which are acquired by the <br />Contractor during the pendency of this Contract to <br />the State within thirty (30) days of their <br />acquisition. At the completion of the contract. the <br />State shall convey any such shares back to the <br />Contractor. with no additional encumbrances other <br />than those existing at the time of transfer to the <br />State. However. in the event that the Contractor <br />does not fulfill all of its obligations under this <br />contract, it agrees that the State shall be entitled <br />to any such shares and be able to sell or otherwise <br />dispose of the shares in addition to other remedies <br />specified herein. The State agrees that during the <br />pendency of this Contract and as long as the <br />Contractor is not in breach, it will allow the <br />Contractor to use the water represented by any such <br />shares. <br /> <br />8. Permit periodic inspection of the project by <br />authorized representatives of the State during and after <br />construction. <br /> <br />9. Without expense to the State, manage, operate, and <br />maintain the project system continuously in an efficient and <br />economical manner, and assume all legal liability for such <br />management, operation, and maintenance. The Contractor agrees <br />to indemnify and hold the State harmless from any liability to <br />the extent permitted by law as a result of the State's <br />ownership of the project facilities identified in paragraph 6 <br />above. The Contractor shall maintain general liability <br />insurance covering the management, operation, and maintenance <br />of the project system until it has completed purchase of the <br />project system from the State in at least th~ following <br />amounts: <br /> <br />a. For any injury to one person in any single <br />occurrence, the sum of One Hundred Fifty Thousand <br />Dollars ($150,000). <br /> <br />b. For any injury to two or more persons in any <br />single occurrence, the sum of Four Hundred Thousand <br />Dollars ($400,000). <br /> <br />Said liability insurance shall name the State as a co-insured. <br />A copy of a certificate of said liability insurance must be <br />filed with the Colorado Water Conservation Board prior to ~he <br />start of the operation of the proJ'ect system. <br />/', <br /> <br />10. Make the services of said project available within its <br />capacity to all persons in the Contractor's service area <br />without discrimination as to race, color, religion, or natural <br />origin. The rate schedule for 1984 shall be: <br /> <br />a. User fee $300 per year per residence <br /> $204 per year per multi-family <br /> unit <br />b. Standby fee - $32 per month per lot equivalent <br />c. Hookup fee $200 + per tap. <br /> <br />That for the years commencing January 1, 1985, and <br />thereafter, the Contractor anticipates reducing the above fees <br />to ~150 per year per Single-family residential unit and $102 <br />per year for mUlti-family residential unit.
