<br />WHEREAS. authority nists in the Law and Funds have been budreted. appropriated and otherwise m.de
<br />available and a sufficient unencumbered balance thereof remains avaU.ble for payment in Fund Number 4008
<br />G/l Account Number 5358X, Contract Encumbrance NumberC1S3 366: and
<br />ABL Account Number 13582, Org. Unit 77-77-777,
<br />
<br />WHEREAS. required approyal. c1ear-mee and coordination bas been accomplished from and with appropriate
<br />agencies; and
<br />
<br />WHEREAS, pursuant to the provisions of 37-60-119, Co~orado
<br />Revised Statutes, as amended, the State.is autnorized to
<br />construct certain water oroie~ts for the benefit of the people
<br />of the State, and - .
<br />
<br />WHEREAS, pursuant to Senate Bill No. 439, Fifty-Third
<br />General Assembly of the State of Colorado, duly enacted into
<br />law, the Colorado Water Conservation Board has been authorized
<br />to expend a sum not to exceed Two Million Eight Hundred
<br />Sixty-Six Thousand Dollars ($2,866,000) on construction of the
<br />project for the benefit of the Contractor; and
<br />
<br />WHEREAS, the State agreed to construct said project and to
<br />sell the same to the Contractor upon mutually agreeable terms
<br />and conditions, subject to the availability of funding for that
<br />purpose~ and
<br />
<br />WHEREAS, the State and the Contractor have earlier entered
<br />into a contract dated December I, 1981, which contract is
<br />attached hereto as Exhibit A, by which the State paid the
<br />Contractor One Million Seven Hundred Seventy-Six Thousand
<br />Dollars ($1,776,000) to enable the Contractor to construct
<br />certain w~ter supply and irrigation system facilities for the
<br />benefit of the residents of the Ridges Metropolitan District
<br />with a commitment of the Contractor to convey certain
<br />facilities of the water supply and irrigation system to the
<br />State~ and
<br />
<br />WHEREAS, this present contract shall supersede and replace
<br />that certain contract dated December 1, 1981, in its entirety;
<br />and
<br />
<br />WHEREAS, the Contractor prior to the execution of that
<br />certain contract dated December 1, 1981, had already incurred
<br />One Million Four Hundred Fifty-Two Thousand Dollars
<br />($1,452,000) of expenses on portions of the project, which
<br />expenses have been documented by the Contractor to the State's
<br />satisfaction: and
<br />
<br />WHEREAS, the Contractor has expended an additional Three
<br />Hundred Forty-Two Thousand Seven Hundred Fifty Dollars
<br />($342,750) on the.project in.addition to the One Million Four
<br />Hundred Fifty-Two Thousand Dollars ($1,452,000) identified
<br />above, which additional expenses have been documented to the
<br />State's satisfaction: and
<br />
<br />WHEREAS, the field conditions encountered during
<br />construction were found to be different from those presented
<br />in the investigation report; and
<br />
<br />WHEREAS, such field conditions necessitated redesign of
<br />structures and adjustments which increased the cost of the
<br />pro j ect ~ and
