<br />ARTICLE III. <br />ADDITIONAL MATTERS <br /> <br />Section 1. The corporation will receive waters from the Cache La Poudre River <br />basin. <br /> <br />Section 2. The water shall be received by this corporation at one or more <br />structures including but not limited to the No.2 Ditch located in Section Sixteen (16), <br />Township Six (6) North, Range Sixty-seven (67) West of the 6th P.M., Weld County, <br />Colorado. <br /> <br />Section 3. The reservoir already in existence is also known as Windsor Lake and <br />is located in the East Half (E%) of Section Seventeen (17) and Section Sixteen (16), <br />Township Six (6) North, Range Sixty-seven (67) West of the 6th P.M., Weld County, <br />Colorado. <br /> <br />Section 4. The outlet structure is in existence and is located in the Southeast <br />Quarter (SEY.) of Section Sixteen (16), Township Six (6) North, Range Sixty-seven (67) <br />West and the outlet ditch flows in a general Southeast direction through Sections 16,21, <br />22 and ending in Section 27, all located in Township Six (6) North, Range Sixty-seven (67) <br />West, Weld County, Colorado. <br /> <br />Section 5. The waters ofthis corporation are to be used for irrigation, recreation, <br />municipal, piscatorial, wildlife conservation, wetland development, augmentation and <br />domestic uses or such other uses as deemed appropriate by the corporation. <br /> <br />ARTICLE IV. <br />LIFE OF THE BUSINESS <br /> <br />The period of existence of the corporation shall be perpetual. <br /> <br />ARTICLE V. <br />TAX EXEMPT <br /> <br />Section 1. This corporation is organized exclusively for non-profit purposes so as <br />to be exempt from federal income taxes under 26 USC, 3501, or other corresponding <br />provisions of any future United States Internal Revenue Code Law. <br /> <br />Section 2. Upon termination or dissolution of the corporation, the distribution of <br />any surplus property and/or assets remaining after all of the debts and obligations of the <br />corporation have been paid and satisfied, shall be governed under the appropriate <br />provisions granted to non-profit corporations organized and existing under the present <br />statutes of the State of Colorado and any Acts supplementary or amendatory to thereof. <br /> <br />F:\KFL\KERN.RESERVOIR\ARTICLESJNCORPORA TtON <br /> <br />2 <br />
