: ~"', " EXHIBIT A SPECIAL WARRANTY WATER DEED This deed is made the ____ day of , ____, between the Colorado River Water Conservation District, GRANTOR, and the City and County of Denver, acting by and through its Board of Water Commissioners, GRANTEE, whose legal address is 1600 West 12th Avenue, Denver, Colorado 80254, of the City and County of Denver, State of Colorado; WITNESSETH, That the Grantor for and in consideration of the Grantee's payments to Grantor pursuant to the Agreement Amending Lease Agreement dated July 21, 1992, and the Grantee's annual payment of forty percent (40%) of all operation, maintenance and rehabilitation expenses in connection with the Wolford Mountain Reservoir, the sufficiency of which is hereby acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell, convey and confirm unto the Grantee, its successors and assigns the ownership, use and control of forty percent (40%) of the storage capacity in the Wolford Mountain Reservoir and forty percent (40%) of the water right, defined as any decree for the storage of water which the Grantor owns at the site of the Reservoir. The Grantor for itself, successors and assigns does covenant and agree that it shall and will warrant and forever defend the above-described conveyance in the quiet and peaceful possession of the Grantee, its successors and assigns, against all and every person or persons claiming the whole or any part thereof, by, through, or under the Grantor, subject, however, to the Agreement Amending the Lease Agreement, dated July ____, 1992, and recorded in Book ____ at Page ____ of the Grand County Records.
