<br />with a team of Boyle Engineering Corporation and Harza <br />(Engineer) . <br /> <br />b. The contract for the construction of the dam will be <br />bid by unit price based upon engineer estimates of unit <br />quantities. At the end of any period of delay in issuance of <br />a Notice of Award due to a request by Denver under this <br />paragraph, the River District and Denver shall jointly <br />negotiate with the accepted low bidder to obtain a unit price <br />as close as possible to the bid price. If the unit price <br />offered by the accepted low bidder is unacceptable to either <br />the River District or Denver, the project will be re-bid. <br />Denver shall be responsible for paying any increase in cost <br />between the originally bid unit price of the accepted low <br />bidder and the new unit price agreed upon with the accepted <br />low bidder or the re-bid unit price, whichever is applicable. <br />The cost increase due to delay, calculated by multiplying the <br />unit price increase by the actual number of units, shall be <br />pro-rated into quarterly payments over the construction <br />period, and shall be added to Denver's payments pursuant to <br />Exhibit B. <br /> <br />c. The highway relocation contract is scheduled for bid <br />in the third quarter of 1993 for construction in 1994. If <br />commencement of dam construction were delayed one year, it <br />would not materially affect the highway relocation contract. <br />However, if a delay due to a request by Denver under this <br />Paragraph 18 delays the solicitation of bids for the highway <br />relocation contract beyond October 1, 1993, Denver shall pay <br />the increased cost of construction attributable to such delay, <br />to be calculated as follows: <br /> <br />Increase = AP x M/12 x BP <br /> <br />where AP = the percentage of increase in the cost of road <br />construction projects during the most recent 12 months, as <br />contained in the Construction Cost Index published quarterly <br />by the Colorado Department of Transportation; M = the number <br />of months of delay past October 1, 1993; and BP = the bid <br />price for the highway relocation project. The cost increase <br />due to delay, calculated pursuant to this subparagraph, shall <br />be added to Denver's first quarterly payment pursuant to <br />Exhibit B which is due after a Notice of Award for the highway <br />relocation project has been issued. <br /> <br />d. The contract for Engineering Services during Construction <br />with Boyle Engineering and Harza is a "time and expenses" <br />contract with the major cost component being personnel costs. <br />The contract will have an annual percentage cost increase for <br /> <br />8 <br /> <br />'" <br />
