shall be defined as a condition when ~enver requests the release of

Reservoir water to conduct exchanges, not having other sources of

exchange capability reasonably available, and the requested amount

of Reservoir ~ater could not be delivered through the Project outlet

works. To the extent impairment occurs, the next annual rental

payment will be determined by the amount of water actually delivered

divided by 15,000, or the amount of water requested if less than

15,000, times the Base Rental, as adjusted pursuant to paragraph 8

below.

8. CHANGE IN RENT 'BASED ON INDEX: The Base Rental to be

paid by Denver to the River District shall be subject to increase at

the end of the 8th year after the Reservoir is Operational and to

either increase or decrease at the end of the 16th year after the

Reservoir is Operational. The Consumer Prics Index publiShed by the

Bureau of Labor Statistics of the O. S. Department of Labor, All

Orban ConsUrners-~)-,\J".--s-:'-Cit7- Xverage- (-Index-) shall be

ascertained for the month of January in the first year when the

Reservoir becomes Operational (-Base Index:). Thereafter, on

January 1 of the 9th and 17th years after the Reservoir 'Jecomes

Operational, the corresponding Index for the most current available

date shall be ascertained. If such Index shows an increase or

decrease from the Base Index then the Base Rental shall be increased

or decreased in direct proportion to the increase or decrease in the

Index, provided, however, no increase or decrease may exceed 10

percent of the original Base Rental nor may the rental rate decrease

at any time to less than the original Base Rental as determined
