<br />. <br />Annual Yield which the River District determines, at its sole <br /> <br />discretion, is not necessary for Western Colorado uses. In the 6th <br />,year prior to the end of the te~, the River District will give <br />notice of its determination of the amOunt of ' water which will be <br />available for lease to Denver. Denver shall have ODe year after <br />such notice is given within which to notify the River District of <br />its intent to renew and the parties shall then negotiate the terms <br />aDd,conditions. <br /> <br />7. RENTA~ PAYMENTS: In January of the first year after <br />the River District shall have commenced construction of the dam and <br />in January of each year thereafter until the project is deemed <br />Operational, Denver shall pay the River District the fOllowing <br />interim payments: <br /> <br />1st year $ 500,000.00 <br />2nd year $ 750,000.00 <br />3rd year $1,250,000.00 <br />4th year $1,250,000.00 <br />5th year $1,250,000.00. <br /> <br />If the project is not deemed Operational within 6 years from the <br /> <br /> <br />time ,the River District commenceS construction of the dam, Denver's <br /> <br />payments shall cease until the month of January after the project is <br /> <br /> <br />deemed Operational, and if the project is not deemed Operational <br /> <br /> <br />within 9 years after the River District commenced construction of <br /> <br /> <br />the dam, Denver shall have the right and privilege to terminate this <br />
