Without expense to the state, manage, operate, and <br />maintain the project continuously in an efficient and economical <br />manner and assume all legal liability for such management, <br />operation, and maintenance. The Contractor agrees to indemnify <br />and hold the state harmless from any liabili~y as a result of <br />the state's involvement with the project as specified in <br />paragraph 4 of Special provisions attached hereto and made a <br />part hereof. <br /> <br />8. until it completes payment to the State, maintain <br />either general liability insurance covering the management, <br />operation, and maintenance of the project or cash reserves for <br />that purpose in at least the amounts which, at a maximum, could <br />be recovered against the Contractor pursuant to the Colorado <br />Governmental Immunity Act, Section 24-10-101, et seq., C.R.S., <br />as said act now exists or may hereafter be amended. Said <br />liability insurance shall name the state as a co-insured. A <br />copy of a certificate of said liability insurance must be filed <br />with the State, or cash reserves established in amounts and in a <br />manner satisfactory to the state, prior to the start of the <br />operation of the project. <br /> <br />9. Make the services of the project available within its <br />capacity to all persons in the Contractor's service area without <br />discrimination as to race, color, religion, or national origin <br />at reasonable charges, including assessments, taxes, or fees, <br />whether for one or more classes of service, in accordance with a <br />schedule of charges" formally adopted by the Contractor through <br />its duly authorized officials, as may be modified from time to <br />time. The initial rate schedule must be approved by the State. <br />Thereafter, the Contractor may, subject to the prior written <br />approval of the State, make such modifications to the rate <br />schedule as the Contractor deems necessary to efficiently and <br />economically provide for the financial requirements of the <br />system as long as the rate schedule remains reasonable and non- <br />discriminatory. <br /> <br />10. Adjust its operating costs and service charges from <br />time to time, upon written notice from the State, to provide for <br />adequate operation and maintenance, emergency repair services, <br />obsolescence reserves, and debt reserves. <br /> <br />11. Provide the state with such periodic reports on the <br />condition, operation, and maintenance of the project as the <br />State may require and permit periodic inspections of its <br />operations, financial accounts, and records by a designated <br />representative of the State. <br /> <br />12.
