<br />. <br />, <br /> <br />I <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />- <br /> <br />. <br /> <br />INTRODUCTION: <br /> <br />The Tremont Mutual Ditch Company "Tremont" diverts water from the South Platte <br />River near Fort Morgan, Colorado and carries the water to approximately 2,000 acres <br />of land which lie near the town of Snyder, Colorado. There are 2,000 shares of stock <br />issued to 15 stockholders, <br /> <br />Tremont also diverts and transports water for the Snyder Smith Ditch Company <br />"Snyder Smith" through its headgate and canal and delivers the water into the Snyder <br />Smith Canal near Snyder, Colorado. There are 10 shareholders in Snyder Smith who <br />irrigate approximately 3,000 acres of land North and East of Snyder. In consideration <br />for diverting and delivering this water, Snyder Smith is responsible for paying one half <br />of all maintenance cost incurred by the Tremont system. Snyder Smith is responsible <br />for paying one half of the cost of this project. <br /> <br />Pioneer Water and Irrigation, Inc, "Pioneer" is a Colorado corporation composed of <br />the stockholders of Tremont and Snyder Smith, There are a few outside stockholders <br />who have purchased stock in Pioneer. Pioneer has 4,000 shares of stock outstanding, <br />issued to 25 stockholders, Pioneer's purpose is to divert water from the South Platte <br />River and deposit it into various recharge sites along the canals of both the Tremont <br />and Snyder Smith systems, Pioneer pays a running fee of $2,50 per acre foot of water <br />which is diverted on its behalf and carried to one of the many recharge sites, This fee <br />is evenly divided between the Tremont and Snyder Smith systems, <br /> <br />DECREES: <br /> <br />Name <br />A. The <br />Tremont diversion is on the North side of the South Platte River and is located <br />upstream of the Lower Platte and Beaver river diversion, The Lower Platte and Beaver <br />diversion is a state of the art rollover type diversion which was installed following the <br />flood of 1965, During the six weeks which the river was in flood condition, the river <br />changed its course through the Tremont diversion ditch and went north around the <br /> <br />2 <br />
