the water year prior to said date. Any failure or refusal of

Pioneer to pay said handling fee when due shall forfeit the

right of Pioneer to receive any waters under said decree sub-

sequent thereto until all said handling fees are current.

5. The term of this agreement shall be perpetual, except

that the handling fees as provided in this agreement may be

adjusted an~ually upon the agreement of the Ditches and Pioneer
or on the basis of the handling fees charged by the Ditches in

any year to other users of the Ditch System for carrying foreign

waters or other decreed waters not owned or controlled by the

Ditches.

6. Pioneer will have no liability for any damage to systems

owned by the respective ditches. Any structures needed and

desired by Pioneer may at pioneer's request be approved and

installed by the respective ditches and reimbursed by Pioneer.
