WHEREAS." pursuant to the provisions of 37-60-119. Colorado
Revised Statutes 1973, as amended, the State is authorized ~o
construct certain vater projects for the benefit of the people
~f the State! and

WHEREAS. 'the Contractor ia a Water District in the State
of Colorado and wishes ~o undertake repairs to its rU~al
domestic vater system, hereinafter called the project. far the
Broo~ Forest community in Jefferson County. COlorado, at an
e$timated cost of Three Hundred and Twenty-Nine Thousand
Dollars (~329.0001! and

WHEREAS, a feasibility investigation of said project vas
conducted and it was found that such a project is economically
.feasible! and

WHEREAS. the State has agreed to construct said project and
~o sell ~be same to the Contractor upon mutu~lly agreeable
terms and conditions, subjec~ to tne availability of funding
for that purpose: and

WHEREAS, pu~suant to Senate Bill No. 67, Fifty-Second
General Assembly of the State of Colorado, duly enacte~ into
law, the Colorado l'later Conservation Board has been au thol:'i~ed
to expend a sum not to ex.ceed Two i1\ln<lred and FiEty '{'hous.~nd
Dollars (~250.001l1 for construction of the project;

NOW THEREFORE, in consideration of the mutual and
dependent covenants herein contained, it is agreed by the
parties hereto au follows:

A. The Contrac1~or agrees that it shall;

1. Employ an engineering firm to prepare project plans
and specifications for tlle proposed project. Both the
engineering firm and the project plans and specifications shall
be approved by the State,

2. Sub-con~ract the construction of uai~ project to a
rosponsible and ,~apa'ble firm, said project to be completed
within two (2) y.~al's of the date of this contract in accorilancc
with the project plan~ and specification. and any necessary
modification the::eof a['provcd by the St.ate. The State must
approve, in writ.lng, a 11 sub-contracts before they become
effective. The .,hove-mentioned time lnay be extended by the
State if such time is insu fficient because of acts of God or
otner acts or circumstances beyond the cont~ol of tbe
Contractor..
