<br />~GRESS-EGRESS ACCESS EASEMENT <br /> <br />\)R~ft <br /> <br />THIS AGREEMENT, made and entered into this <br />2002, by and between <br />address is <br />grammatically singular or plural), and <br /> <br />day of <br /> <br />, whose legal <br />hereinafter called "Grantor" (whether <br />, whose address is <br />, hereinafter called "Grantee," <br /> <br />FORAND IN CONSIDERATION of the sum of$ to the <br />Grantor in hand paid by the Grantee, receipt of which is hereby acknowledged, and in <br />consideration of the mutual covenants contained herein, Grantor hereby grants, bargains and sells <br />to the Grantee, its successors and assigns, a permanent access easement to the property described <br />below, together with the perpetual easement and right-or-way for ingress and egress thereto and <br />therefrom over, under and across the following described land located in the County of Jefferson, <br />State of Colorado, described in Exhibit A. <br /> <br />IT IS HEREBY MUTUALLY COVENANTED AND AGREED by and between Grantoi: <br />and the Grantee as follows: <br /> <br />1. The Grantee shall have and exercise the unimpeded right of ingress and egress in, to, over, <br />through and across the property described in Exhibit A for any purpose needed for the full <br />enjoyment of any rights or use provided for herein. <br /> <br />2. The Grantor shall not construct or place any building, or other structure or object which <br />interferes with the use of the easement granted herein. Any object interfering with the Grantee's <br />use of this easement may be removed by the Grantee without liability to the Grantor for damages. <br />The Grantee agrees to notify Grantor prior to removal of any landscaping. Grantor may plant <br />vegetation within said easement, provided that the root system of the vegetation will not interfere <br />with the water line, If Grantor violates these restrictions or if Grantor's actions cause damage to <br />Grantee's lines, Grantor will be liable for the cost to correct said violations or damage, <br /> <br />3. The GIantee shall have and exercise the right of subjacent and lateral. support to the extent <br />necessary for its full, complete and unmolested enjoyment of the rights herein described. The <br />Grantor shall take no action which impairs the earth cover over, or the lateral or subjacent <br />support for, any water pipelines, lines or appurtenances within the easement. If, however, <br />Grantor obtains specific written permission of the Grantee, the earth cover over the water line <br />may be modified. Any modification undertaken by the Grantor shall provide for reimbursement to <br />the Grantee of the cost of any alterations to any of its facilities made necessary by the change, <br />Grantor understands that the Grantee is under no obligation to provide written permission for any <br />such modification. <br /> <br />bfwd.7\access,942002 <br />
