<br />While the District initially obtained title to the property pursuant to an' eminent domain proceeding,
<br />it also had secured funding through a long term loan from the Colorado Water Conservation Board,
<br />Apparently, as a condition of the disbursement of loan funds, .the District agreed to convey title to
<br />the reservoir site to ,the Colorado Water Conservation Board as security,
<br />

<br />As we discussed, the i~sW~s periaini~gto the long term handling' of the reservoir site wouldsuggest
<br />that it may be more appropriate to return the fee interest to the District and have the District, in turn,
<br />execute a trust deed for the security on the loan.
<br />
<br />The more urgent issue is that the owner of a contiguous parcel of ground received an easement from
<br />the District purporting to give him access and egress to his property across the reservoir site. That
<br />individual is currently attempting to get approval on an exemption to platting in Jefferson County
<br />which is being held up as a result of the questionson the title to the reservoir site, The District is
