<br />,. <br />( ) <br /> <br />. <br /> <br />( '! <br /> <br />AND FURTHER BE IT RESOLVED, that the wildlife commission, subject <br />to the concurrence of the Colorado Water Conservation Board, <br />recommends that a grant to the Colorado River Water Conservation <br />District be made from the fish and wildlife resources account of <br />the Colorado Water Conservation Board construction fund with the <br />following conditions: <br /> <br />MITIGATION GRhNT CONDITIONS <br /> <br />A. That a mitigation grant, not exceeding $1,278,828.00 be made <br />for the purpose of funding a portion of l:he mitigation costs of the <br />Muddy Creek Reservoir project, with the exception of those <br />mitigation measures pertaining to the Ousterhout's Milkvetch, the <br />cost of which will be funded solely by the Colorado River Water <br />conservation District; and <br /> <br />B. That grant monies not ne~ded f"r initial mitigation of <br />construction/development of the MUddy Cr,:ek Reservoir project shall <br />be set asid~ by the Colorado Riv~r Water conservation District in <br />a special trust fund established for the specific purpose of <br />funding future mitigation actions required under the MITIGATION <br />PLAN FOR THE MUDDY CREEK RESERV01R PROJECT; and <br /> <br />C. That the Colorado River WateI:' Conservation District regularly, <br />but not less than once each yea.r, consult with the Division of <br />wildlife and the U. S. BureajJ of Land Management on the <br />effectiveness of the mitigation measures contained in the <br />MITIGATION PLAN FOR THE MUDDY CREEK RESE~VOIR PROJECT and consider <br />implementing recommendations froll\ the DOW or BLM for iInproving the <br />mitigation measures contained th~rein. <br /> <br />D. That the colorado River Water Conservation District will <br />cooperate with the Colorado Water Conservation Board and the <br />Colorado Division of wildlife during thE! three years following the <br />completion of the construction ot the Wolford Mountain Project to <br />evaluate the reach of Muddy Cr~ek below the project for water <br />quality, sediment, and habitat, for the purpose of determining the <br />filing for a.n instream flow pursuant to C.R.S. 37-92-102; and, that <br />should such evaluations indicate that the potential exists to <br />develop an instream fishery belo~ the project, the Colorado River <br />Water Conservation District will apply to the Colorado Wildlife <br />Commission and Colorado Water Conservation Board for an Enhancement <br />Grant, pursuant to HB 87-1158, to develop that fishery. <br /> <br />APPROVED: 6~/J1{.;) ~~DATE:a(PM1b/' /2,/99/ <br />Eldon w. cooper, ' / <br />Chairman, ' <br />Colorado wildlife commission <br /> <br />-~- <br />
