'-j !Cj0q , by and <br />between the State of Colorado for the use and benefit of the Department of Natural Resources, <br />Colorado Water Conservation Board, hereinafter referred to as CWCB or the STATE, and the Board of <br />County Commissioners of Jefferson County, State of Colorado, 100 Jefferson County Parkway, Golden, <br />Colorado 80419-3550, hereinafter referred to as the CONTRACTOR. <br /> <br />fACTUAL RIECllTALS <br /> <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise made <br />available,lt,n~ a sufficient unencumbered balance thereof remains available for payment in Fund <br />Number ~ Organization YYYY, Appropriation SEV, GBL J855 Program WTRC, Object Code <br />5120, Reporting Category 3855, Contract Encumbrance Number C153855. <br /> <br />8. Required approval, clearance, and coordination have been accomplished from and with appropriate <br />agencies. <br /> <br />C. Pursuant to Section 39-29-109(1)(a), C.R.S. (1997), the STATE is authorized to fund water resource <br />planning at the local level from the Operational Account of the Severance Tax Trust Fund. <br /> <br />D. The CONTRACTOR, through the Jefferson County Planning and Zoning Depaiiment, is coordinating <br />the Jefferson County Mountain Ground Water Resources Study ("STUDY"), which will define the <br />present quantity and quality of the ground water resources within the Turkey Creek Basin of the <br />mountainous part of Jefferson County, monitor ground water levels, precipitation and water quality, <br />and provide a method to simulate effects of current and future development of said ground water <br />resources. <br /> <br />E. The STATE has determined that the information compiled in the STUDY will assist in local water <br />resource planning efforts both in the STUDY area and in other mountainous areas along the Front <br />Range. <br /> <br />F. The CONTRACTOR, the STATE and other entities, including the United States Environmental <br />Protection Agency ("EPA") and the United States Geological Survey ("USGS"), have agreed to <br />sponsor the STUDY. Each entity shall participate in the STUDY by contributing cash and/or in-kind <br />services, and shall enter into a separate arrangement with the CONTRACTOR for the provision of its <br />individual contribution. <br /> <br />G. The CONTRACTOR shall direct the performance of the STUDY with advice from the Jefferson County <br />Mountain Water Resources Steering Committee, comprised of representatives of the CONTRACTOR, <br />the Colorado Division of Water Resources, the EPA, the USGS, and other state and local entities <br />and interested parties. <br /> <br />H. The CONTRACTOR has approved a scope of work for the STUDY tasks prepared by the USGS. <br /> <br />Page 1 of 6 <br />
